Introduction
These Terms and Conditions (“Terms”) govern your use of BRITE-X Auctioneers website and services (collectively, the “Service”) operated by BRITE-X Auctioneers (“we,” “us,” or “our”). By accessing or using the Service, you agree to be bound by these Terms. If you disagree with any part of the Terms, you may not access the Service.
User Accounts
When you create an account with us, you must provide information that is accurate, complete, and current at all times. Failure to do so constitutes a breach of the Terms, which may result in immediate termination of your account on our Service.
You are responsible for safeguarding the login and password that you use to access Service and for any activities or actions under your login details. You agree not to disclose your login details to any third party. You must notify us immediately upon becoming aware of any breach of security or unauthorized use of your account.
Auction Participation
By placing a bid, you are making a binding offer to purchase the item at the bid price. All bids are final and cannot be retracted. If your bid is successful, you are obligated to complete the purchase transaction.
BRITE-X Auctioneers reserves the right to remove, or refuse to post any bids that are deemed inappropriate, suspicious, or in violation of these Terms. Users must be at least 18 years of age and have the legal capacity to enter into binding contracts to participate in auctions.
Buyer’s Premium and Fees
A buyer’s premium may be charged on all successful bids. The amount of the premium will be clearly stated in the auction details before bidding begins. Additional fees such as VAT, shipping, handling, and storage may also apply and will be clearly communicated.
Item Description and Condition
While we strive to ensure that all item descriptions are accurate, we do not warrant that such descriptions or other content on the Service are accurate, complete, reliable, current, or error-free. Items are sold “as is” with no warranties expressed or implied.
Intellectual Property
The Service and its original content, features, and functionality are and will remain the exclusive property of BRITE-X Auctioneers / Partners and its licensors. Our trademarks and trade dress may not be used in connection with any product or service without our prior written consent.
Limitation of Liability
In no event shall BRITE-X Auctioneers, nor its directors, employees, partners, agents, suppliers, or affiliates, be liable for any indirect, incidental, special, consequential or punitive damages, including without limitation, loss of profits, data, use, goodwill, or other intangible losses, resulting from your access to or use of or inability to access or use the Service.
Governing Law
These Terms shall be governed and construed in accordance with the laws of South Africa, without regard to its conflict of law provisions. Any disputes relating to these Terms shall be subject to the exclusive jurisdiction of the courts of South Africa.
Changes to Terms
We reserve the right, at our sole discretion, to modify or replace these Terms at any time. If a revision is material, we will try to provide at least 30 days’ notice prior to any new terms taking effect. What constitutes a material change will be determined at our sole discretion.
